Metropolitan District Changes Adopted October 12, 2021

UPDATE: On October 12, 2021, City Council adopted an ordinance amending the City's model service plan, model intergovernmental agreement, and Chapter 66 of the City Code for metropolitan districts ('metro districts'). The changes are intended to: 1) ensure homeowners are adequately informed about metro districts and tax obligations; 2) set limitations to protect homeowners from excessive tax burdens; and 3) ensure metro districts remain a viable tool for developers to fund necessary and required infrastructure and services.

Metro District Application Information for May 2022 Election

Applicants requesting City approval of a service plan or intergovernmental agreement in time for the May 2022 election will be required to use the model service plan and intergovernmental agreement forms adopted on October 12, 2021. Additionally, applicants shall submit all other required application information and fees as outlined in the application instructions. Applications are due by November 12, 2021. Applications received after this date will not be reviewed in time for the May election. Contact the City Development Department at 303.538.7295 for questions.

2021 City Council Meetings to Adopt Changes:

1) September 28, 2021 Council Meeting - First reading of the ordinance; ordinance passed unanimously

2021 Council Educational Sessions:

Staff provided education sessions to City Council as follows:

1) March 23, 2021 Council Update - overview on the purpose and background of metro districts in Colorado

2) April 6, 2021 Planning Session - review of City's metro district regulatory history, and application and review procedures 

3) April 20, 2021 Planning Session - Discussion of recommended changes to the City's metro district regulations including amendments to the model service plan and intergovernmental agreement forms, and City Code based on direction from Council and feedback from stakeholders and the community. Note: During this meeting, Council directed staff to reorganize the presentation content and continue the presentation on a subsequent date.  

4July 6, 2021 Planning Session - The presentation on recommended changes to the City's metro district regulations was continued to the July 6th Planning Session. City Council directed staff to bring forward an ordinance amending Chapter 66 of the City Code, and the new model service plan and model intergovernmental agreement for formal consideration in September 2021.

Progression of Proposed Changes

6th Draft - September 2021 Proposed Changes:

Staff made two changes to the June 2021 version of the proposed model service plan: 1) The definition of "Approved Conceptual Site Plan" was rewritten to provide clarification and reference the City Code section that regulates Conceptual Site Plans; and 2) the itemized list of information required to be included in the disclosure form to homebuyers was removed and replaced with a reference to C.R.S. which was amended in the 2021 legislative session to identify additional requirements for disclosure. This latest draft model service plan will be included in the packet for the September 28, 2021 City Council meeting for adoption and can be found under the "6th Draft - September 2021 Proposed Changes" column.

5th Draft - June 2021 Proposed Changes:

Staff made minor revisions to the proposed model service plan to conform with Senate Bill 21-262 signed into law on June 28, 2021. This draft model service plan was included in the packet for the July 6, 2021 Planning Session and can be found under the "5th Draft - June 2021 Proposed Changes" column along with all stakeholder comments received through July 6, 2021 and Colorado Senate Bill 21-262 for reference.

4th Draft - April 2021 Proposed Changes:

The fourth draft is essentially the same as the third draft. This version merely shows all changes together without identifying which changes were from February and which changes were from January as shown in the third draft. The April version has very minor "clean up" edits. Staff This version was prepared for inclusion in the packet for the April 20, 2021 Planning Session. 3rd Draft - February 2021 Proposed Changes:

Staff made revisions to the January 2021 proposed model service plan based on stakeholder comments received in January. Staff completed a new draft which shows the January changes in red text and February changes in green text. Please see the links under the "3rd Draft - February 2021 Proposed Changes" column to view the draft February 2021 model service plan changes and staff responses to January stakeholder comments.

2nd Draft - January 2021 Proposed Changes:

Staff made revisions to the initial July 2020 proposed changes based on stakeholder comments received in July. Staff completed a new summary of proposed changes and a red-lined draft of the City's model service plan for metropolitan districts reflecting proposed changes. Staff is in the process of reviewing stakeholder comments to the January 2021 draft. The City held a second public webinar on January 28, 2021 to discuss the January changes.

1st Draft - July 2020 Proposed Changes:

Staff drafted initial options for changes in July 2020. A packet identifying the options that were initially contemplated is available under the "1st Draft - July 2020 Proposed Changes" links column. The City held a public webinar on July 15, 2020 to discuss the issues and the July proposed changes. Staff received many comments from stakeholders on these initial proposed changes and spent many months deliberating on how to make revisions that best balanced the needs of the City, City residents, and metro districts.

Applicability

Changes to the City's model service plan, model intergovernmental agreement, and City Code would be applicable to new applications including requests for amendments. These changes are not applicable to existing service plans or intergovernmental agreements already approved.
