Request for Proposals - Hearing Officers

The City of Thornton seeks proposals from qualified candidates to serve as a Hearing Officer for various municipal administrative hearings. Hearing officers will be appointed by the governing body in the subjects of marijuana licensing, liquor licensing, Building Code Advisory Board, and other subject areas under the Thornton City Code, by way of example not limitation. The initial term of the agreement is anticipated to be for one year with the option to renew for four additional years, or as otherwise determined by City Council.  Fees and other terms will be established by the appointing documents.

Questions regarding proposal requirements must be received by the City Clerk's office, in writing at clerk@thorntonco.gov by 5:00 PM MST on September 15, 2020. Oral and late questions will not receive responses.

Proposals must be received no later than 5:00 PM MST September 18, 2020.  Proposals shall be submitted electronically to clerk@thorntonco.gov or by mail at the City Clerk's Office, 9500 Civic Center Drive, Thornton, CO 80229. PUBLIC NOTICE IS HEREBY GIVEN that there has been filed with the City Clerk, City of Thornton, Adams County, Colorado, a First Amended and Restated Service Plan and related documents for the Parterre Metropolitan District Nos. 1-8 (the "Districts").  Maps of the Districts along with the proposed First Amended and Restated Service Plan is now on file at the City of Thornton City Hall, 9500 Civic Center Drive, Thornton, Colorado, 80229-4326, and is available for public inspection.  Please email clerk@thorntonCO.gov to request a copy.

 The Districts each currently consist of approximately 1,600 square feet of residential and nonresidential land located entirely within the City of Thornton, generally located between Quebec Street on the west, E-470 on the north, and East 144th Avenue on the south.  The Districts intend to include an additional 796.7 acres into their boundaries, consisting of residential and nonresidential land. The area to be included into the Districts is generally located entirely within the City of Thornton and is generally located between Holly Street on the West, Quebec Street on the east, East 152nd Avenue and Ehler Parkway on the north and East 140th Avenue on the south.

 The Districts were previously organized as metropolitan districts to finance the construction of certain public improvements for Parterre development and has the authority to impose a mill levy for repayment of debt and for limited administrative, operation and maintenance purposes. The purpose of the proposed First Amended and Restated Service Plan is to (1) add a maximum mill levy for operations and maintenance services; (2) increase the total debt issuance limitation from $85,000,000 to $235,000,000; (3) add a conveyance provision; (4) add increased community engagement provisions; (5) describe which public improvements may be financed from proceeds of debt issued by the Districts; (6) delete the ability for the Districts' Maximum Debt Mill Levy to become unlimited; and (6) add a form disclosure notice.

 For debt service, the proposed First Amended and Restated Service Plan states that the maximum mill levy that may be imposed upon taxable property within the Districts' boundaries shall not exceed 50 mills. For operations and maintenance services, the proposed First Amended and Restated Service Plan states that the maximum mill levy that may be imposed upon taxable property within the Districts' boundaries shall not exceed 10 mills. However, if the method of calculating assessed valuation is changed by law, the maximum mill levies above may be increased or decreased to reflect such changes. Such mill levy increases or decreases must be determined by the Districts' Boards of Directors in good faith so that to the extent possible, the actual tax revenues generated by the new mill levies neither increase nor decrease as a result of such changes.  For purposes of the foregoing, a change in the ratio of actual valuation shall be deemed to be a change in the method of calculating assessed valuation.

 NOTICE IS FURTHER GIVEN that any protests or objections to the Districts' proposed First Amended and Restated Service Plan must be submitted in writing to the City Council of the City of Thornton at or prior to the hearing, or any continuance or postponement thereof, in order to be considered.  All protests and objections to the First Amended and Restated Service Plan, as proposed, shall be deemed waived unless presented in writing at the time and manner specified above.
