Notice is hereby given of a hearing before the City Council of the City of Thornton, Colorado, on the 10th day of September 2019, at 7:00 p.m. or as soon thereafter as possible, in the Thornton City Hall Council Chambers, 9500 Civic Center Drive, Thornton, Colorado, for the purpose of amending Chapter 10, Articles I, II, and III, and repealing and reenacting Article IV by adopting by reference the 2018 Edition of the following codes:  International Building Code, International Plumbing Code, International Mechanical Code, International Fuel Gas Code, International Residential Code, International Energy Conservation Code, International Existing Building Code, International Fire Code, International Swimming Pool and Spa Code, 2017 Edition of the National Electrical Code and local amendments thereto of the Thornton City Code. 


At least one copy of the Codes above, set out and referred to in this Ordinance of the Municipal Code, (being considered for adoption and of the adopting ordinance) shall be filed in the office of the City Clerk at least fifteen (15) days preceding the above-stated public hearing and may be inspected during regular business hours. 


The “National Electrical Code”, 2017 Edition, is published by the National Fire Protection Association, One Battery March Park, Quincy, Massachusetts 02169, for the purpose and subject “of minimum regulations for the practical safeguarding of persons and property from the hazards arising from the use of electricity”.

The “International Building Code”, 2018 Edition, is published by the International Code Council, 500 New Jersey Avenue, NW, 6th Floor, Washington D.C. 20001, for the purpose of “establishing minimum standards for the regulation and control of the design, construction, quality of materials, erection, installation, alteration, repair, location, replacement, addition to, use and occupancy, maintenance or demolition of any building or structure or any appurtenances connected or attached to such buildings or structures except for one- and two-family dwellings and townhouses.”


The “International Fire Code”, 2018 Edition, is published by the International Code Council, 500 New Jersey Avenue, NW, 6th Floor, Washington, D.C. 20001, for the purpose of “establishing minimum standards for the regulations consistent with nationally recognized good practice for providing a reasonable level of life safety and property protection from the hazards of fire, explosion or dangerous conditions in new and existing buildings, structures and premises”.


The “International Existing Building Code”, 2018 Edition, is published by the International Code Council, 500 New Jersey Avenue, NW, 6th Floor, Washington, D. C. 20001, for the purpose of “establishing minimum standards for the regulation and control of alternative approaches to achieve compliance with minimum requirements to safeguard the public health, safety and welfare insofar as they are affected by the repair, alteration, and change of occupancy of existing buildings”.


The “International Mechanical Code”, 2018 Edition, is published by the International Code Council, 500 New Jersey Avenue, NW, 6th Floor, Washington D.C. 20001, for the purpose of “establishing minimum standards for the regulation and control of the design, construction, quality of materials, erection, installation, alteration, repair, location, replacement, addition to, use or maintenance of heating, ventilating, cooling, refrigeration system, incinerators, or other miscellaneous heat-producing appliances.”


The “International Fuel Gas Code”, 2018 Edition, is published by the International Code Council, 500 New Jersey Avenue, NW, 6th Floor, Washington D.C. 20001, for the purpose of “establishing minimum standards for the regulation and control of the design, construction, quality of materials, erection, installation, alteration, repair, location, replacement, addition to, use and occupancy, maintenance or use of fuel gas systems.” 


The “International Plumbing Code”, 2018 Edition, is published by the International Code Council, 500 New Jersey Avenue, NW, 6th Floor, Washington D.C. 20001, for the purpose of “establishing minimum standards for the regulation and control of the design, construction, quality of materials, erection, installation, alteration, repair, location, replacement, addition to, use or maintenance of any plumbing system.” 


The “International Residential Code”, 2018 Edition, is published by the International Code Council, 500 New Jersey Avenue, NW, 6th Floor, Washington D.C. 20001, for the purpose of “establishing minimum standards for the regulation and control of the design, construction, quality of materials, erection, installation, alteration, repair, location, replacement, addition to, use and occupancy, maintenance or demolition of one- and two- family dwellings not more than three stories in height and their accessory structures.”

The “International Energy Conservation Code”, 2018 Edition, is published by the International Code Council, 500 New Jersey Avenue, NW, 6th Floor, Washington, D.C. 20001, for the purpose of “establishing minimum standards for the regulation of the design and construction of buildings for the effective use of energy.  This code is intended to provide flexibility to permit the use of innovative approaches and techniques to achieve the effective use of energy”.


The “International Swimming Pool and Spa Code”, 2018 Edition, is published by the International Code Council, 500 New Jersey Avenue, NW, 6th Floor, Washington, D.C. 20001, for the purpose of “establishing minimum standards to safeguard life or limb, health, property and public welfare by regulating and controlling the design, construction, installation, quality of materials, location and maintenance or use of swimming pools and spas”.

Following this hearing, the City Council will consider passage of the adopting Ordinance on final reading of this Ordinance.  The effective date of this Ordinance will be September 16, 2019.

PUBLIC NOTICE IS HEREBY GIVEN that there has been filed with the City Clerk, City of Thornton, Adams County, Colorado, a service plan and related documents for the proposed Eastlake Station North Metropolitan District (the "District").  A map of the District along with the proposed service plan is now on file at the City of Thornton City Hall, 9500 Civic Center Drive, Thornton, Colorado, 80229-4326, and is available for public inspection.

NOTICE IS HEREBY FURTHER GIVEN that the City Council of the City of Thornton, Adams County, Colorado, will hold a public hearing at 7:00 pm, or as soon as possible thereafter, on Tuesday, August 27, 2019, in the Council Chambers at the Thornton City Hall, 9500 Civic Center Drive, Thornton, Colorado, to consider approval of the service plan for the District.

The proposed District consists of approximately sixteen (16) acres of commercial and residential land located entirely within the City of Thornton, and is generally located at the southeast corner of E. 126th Avenue and Lafayette Street.  

The proposed District is being organized as a metropolitan district to finance the construction of certain public improvements for the project known as Eastlake Station North. The District shall have the authority to impose a mill levy for repayment of debt and for limited administrative, operation and maintenance purposes. For debt service, the maximum mill levy that may be imposed by the District upon taxable property within the District's boundaries shall not exceed Fifty (50) mills; however, this maximum shall not apply when the total amount of debt is equal to or less than fifty percent (50%) of the District's assessed valuation. There is no maximum mill levy limit that may be imposed by the District upon taxable property within the District for operations and maintenance. If the method of calculating assessed valuation is changed by law, the maximum mill levy may be increased or decreased to reflect such changes.

Any person owning property within the geographical area of the proposed District who requests his or her property to be excluded from the District shall submit a written request for exclusion to the City Council of the City of Thornton no later than 10 days prior to the hearing described herein in order to be considered. 

NOTICE IS FURTHER GIVEN that any protests or objections to the proposed District must be submitted in writing to the City Council of the City of Thornton at or prior to the hearing, or any continuance or postponement thereof, in order to be considered.  All protests and objections to the creation of the District, as proposed, shall be deemed waived unless presented in writing at the time and manner specified above.
